Buyer Payment Services Agreement

Braintree processes Customer Data sent by Merchant to Braintree in order to obtain verification or authorization of the Customer`s payment method as payment to Merchant for goods or services sold. You may only use the Services for legitimate transactions with your customers. You know your customers better than we do and you are responsible for your relationship with them. Stripe is not responsible for any products or services that you post or sell or that your customers purchase through the Services; or if you accept donations, for your communication with your customers about the intended use of those donations. You represent and warrant that you are solely responsible for the nature and quality of the products or services you provide, as well as the delivery, support, refunds, returns and any other ancillary services you provide to your customers. The privacy terms and conditions applicable to this Agreement are set forth in Appendix A (Privacy Addendum) and are incorporated by reference into this Agreement; provided that this Appendix A does not apply to the Venmo Service of PayPal, which is subject to the Privacy Principles set forth in the Venmo Terms of Use under braintreepayments.com. The provisions of the Privacy Addendum shall prevail over any conflicting provisions of this Agreement relating to data protection and privacy. You represent and warrant that you will not knowingly post false or misleading product data or that you will not use Stripe Relay to sell or attempt to sell or attempt to sell illegal products or services through the Applications, and that you are solely responsible for the production, performance, shipping and provision of ancillary services in connection with transactions you receive through your use of Stripe. Whenever a buyer uses a debit or credit card as a payment method for a transaction that uses their account to buy something from you as a seller, the transaction is treated as a “non-existent card” transaction, even if the buyer is at your business location. In the event PayPal is necessary to terminate this Agreement, PayPal will notify you in writing as soon as possible. Even if an international sale takes place, we will settle the proceeds of your transaction to your linked bank account using the currency of that bank account, which is also the currency of your country of residence (“Withdrawal Currency”). However, if this has been offered by us and agreed by you and your buyer, your buyer may pay for an item that you sell in a currency other than your withdrawal currency. In this case, the amount paid will be converted into your withdrawal currency prior to the withdrawal of the money, using the applicable transaction exchange rate and calculating the currency conversion fee as set out on our fee page described in Section 3 (“Seller Payment Fee”) below. PayPal Giving Fund is a donor-advised fund (DAF) recognized by the Internal Revenue Service (IRS) as a tax-exempt public charity (Federal Tax ID: 45-0931286) pursuant to Section 501(c)(3) of the Code. If you meet the eligibility criteria of the Nonprofit Certification Policy and are either a “public charity” under Section 509(a) of the Code or a “private operating foundation” under IRS regulations, you may be automatically enrolled in PayPal Donation Fund upon acceptance of this User Agreement. You will receive an email from us to confirm your registration. Your relationship with PayPal Donation Fund is governed by the Non-Profit Terms of Use, including receiving email communications from PayPal Donation Fund about its current and future partners through its programs. You can unsubscribe from email communications at any time in your PayPal Donation Fund profile. If you are acting as a commercial seller, you agree that § 675f Abs. 5 Satz 2 BGB (Fees for payment services), § 675g BGB (amendment of the framework contract for payment services), § 675h BGB (ordinary termination of a framework contract for payment services), § 675y BGB (liability of the payment service provider in the event of non-execution, incorrect or delayed execution of a payment order; Obligation to inspect), § 675z BGB (Other claims in case of non-execution, defective or delayed execution of a payment order or an unauthorised payment transaction) and § 676 BGB (proof of execution of payment transactions) do not apply to these general terms and conditions for RatePAY payment methods. .
